Ballot Question in April 2 Town Election

When Milford voters go to the polls on April 2 to vote in the Town Election, they will find a question on the ballot asking them to accept Massachusetts General Law Chapter 258, Section 13, which – if accepted – would require the indemnification of municipal officials for claims against them arising out of their employment.

"This statute should have been presented for acceptance many years ago when we put the Town's self insurance program into place," Town Counsel Gerald Moody told the Board of Selectmen when he asked that the question be placed on the ballot. "We should have put this on the ballot in 1990," he told the Milford Town Crier, "to protect employees in case they're sued."

If accepted, the law "requires indemnification of municipal officials for damages, legal fees and costs incurred by them for claims against them or acts arising out of the scope of their employment," according to Moody. The exceptions to that requirement would be "intentional torts and intentional civil rights violations" by officials, he explained.
