Court Backs Selectmen in Scioli Case

A Worcester Superior Court judge has ruled that the Milford Board of Selectmen was within its rights to roll back the closing hour for Scioli's Pizza Bar to 11 p.m. for a six-month period as punishment for events at the bar on the night of March 23 and the early morning of March 24 last year, when two patrons were assaulted by a bar employee and others.

"After thoroughly reviewing the record, the court concludes that the Board's determination that there was a public need to reduce the hours of Scioli's was not an error of law, or arbitrary and capricious," Superior Court Judge James Lemire ruled on January 25.

A Superior Court hearing also was scheduled for this week to review Scioli's appeal of the state Alcoholic Beverage Control Commission's (ABCC) ruling upholding the selectmen's three-week suspension of the bar's liquor license for the same incident. Last September 11, the ABCC ruled in favor of the town, calling the events at the bar a "serious violation" of Scioli's liquor license responsibilities

The two penalties were handed down by selectmen at the end of a three-hour public hearing held last April 30, with both actions "on hold" until all court appeals were exhausted.
