Town Seeks to Dismiss O’Loughlin’s Suit

Lawyers for the Town of Milford, Selectman William Buckley and Selectman William Kingkade have filed motions in Worcester Superior Court seeking to have dismissed the law suit filed against them by Police Chief Thomas O'Loughlin over the non-renewal of his contract.
The motions by the town, Buckley and Kingkade are "nothing that we didn't anticipate because it is usual case in civil cases," said Ernest Horn, O'Loughlin's lawyer. He added, "And, yes, I am sure they expected that we are opposing their motion."
Christopher Brown, the town's outside legal counsel, said he had, "No comment to offer at this point other than we're waiting for the
court to schedule a hearing date." That hearing is now scheduled for April 23.
Brown's written motion to the court asks that O'Loughlin's suit be dismissed on the grounds that the court already upheld the town's arguments when it denied a preliminary injunction requested by O'Loughlin's to prevent the Town of Milford from convening a Police Chief Search Committee and from carrying out the process of not-renewing the chief 's contract.
